    Akosua Serwaa Appeals High Court Ruling on Marriage Certificate

    Akosua Serwaah Fosuh, one of the widows of the late highlife legend Daddy Lumba, has filed an appeal against the Kumasi High Court ruling which held that the marriage certificate she presented in court was inadmissible.

    In a notice of appeal, Ms Serwaah is challenging the entire judgment of the High Court, arguing that the trial court erred in law when it rejected and declared inadmissible the marriage certificate she tendered in support of her claim.

    She further contends that the court was wrong in holding that she had failed to meet the requirements of the Evidence Act, 1975 (NRCD 323) for the admission of the document into evidence.

    The appellant is therefore asking the Court of Appeal to set aside the High Court’s judgment and to declare her as the sole lawful surviving spouse of the late musician.

    High Court Judgment

    On November 28, 2025, the Kumasi High Court, presided over by Justice Dr Dorinda Smith Arthur, dismissed Ms Serwaah’s suit in which she sought a declaration that she was the only surviving spouse of Daddy Lumba.

    The court held that the plaintiff failed to prove that she was married to the deceased under the Marriage Ordinance in a manner that would make her the sole surviving spouse.

    According to the court, the evidence on record showed that Daddy Lumba married Akosua Serwaah under customary law, which is potentially polygamous. Consequently, the court found that his subsequent marriage to Priscilla Ofori, popularly known as Odo Broni, was also valid under Ghanaian law.

    In its final ruling, the High Court declared both Akosua Serwaah and Priscilla Ofori (Odo Broni) as the legally recognised surviving spouses of the late music icon.
