    McDan Aviation Accuses Ghana Airports Company of Breaching Court Injunction at Terminal 1

    McDan Aviation Limited has accused Ghana Airports Company Limited (GACL) of violating a court injunction and breaching contractual obligations following what it described as a midnight operation at Terminal 1 of the Kotoka International Airport.

    In a statement issued on March 12, the company alleged that the actions of the airport operator were intended to undermine its operations while ignoring an ongoing legal process.

    McDan Aviation said it had invested millions of dollars to establish Ghana’s first private Fixed Base Operation (FBO) terminal at Terminal 1 under a licence agreement signed in August 2022. According to the company, the facility has contributed to positioning Ghana as a premium destination for private aviation, tourism, and investment.

    The firm also stated that it had consistently honoured its financial commitments during its operations, including periods when the facility was not operational. Although it acknowledged a brief delay in rent payment, the company said the situation was temporary and that all outstanding amounts had since been settled.

    McDan Aviation argued that describing the delay as a breach of contract misrepresents the circumstances, insisting that it has maintained a longstanding and cooperative relationship with GACL.

    The company further indicated that several attempts to engage the airport authority to resolve the matter were unsuccessful.

    According to McDan Aviation, the licence agreement requires GACL to provide a 90-day eviction notice before taking any action to remove it from the premises. The company alleged that the airport operator failed to comply with this provision.

    The dispute intensified after GACL was reportedly served with a motion for an interlocutory injunction on March 10, 2026. McDan Aviation claimed that despite the court process, GACL officials entered the facility at about 1:00 a.m. on March 11 and removed equipment and property belonging to the company.

    The firm described the action as a deliberate disregard for the court’s injunction and a violation of its contractual rights.

    McDan Aviation said it is pursuing legal action to address what it calls an unlawful termination of its licence agreement, breach of contract, and contempt of court.

    The company reaffirmed its commitment to the development of Ghana’s aviation industry and urged stakeholders to uphold the rule of law while supporting local enterprises that contribute to the country’s global competitiveness.
